1. Agreement to These Terms
These Terms of Service form a binding agreement between you and The Cardfather LLC when you use this website, buy or sell trading cards at our counter, submit cards for grading through our service, join a case break, or attend an event that we host. By doing any of those things, you confirm that you have read these terms and that you accept them.
If you do not accept these terms, please do not use the website or the services described here. Nothing in these terms removes rights that consumer protection law gives you and that cannot lawfully be waived. Where a specific written offer or intake sheet differs from these terms for a particular transaction, the specific document controls for that transaction.
2. About the Shop
The Cardfather LLC is a trading card dealer located at 679 E 400 N, Spanish Fork - 84660-1603, United States (US). The shop buys, sells, grades, and brokers collectible trading cards, runs case breaks, and organises card shows in the surrounding region. This website provides information about those services and a way to contact the shop.
We operate as a retail dealer and not as a financial adviser, investment adviser, appraiser for legal proceedings, or insurer. Statements about market demand, grading outcomes, or the likely value of a card are informed opinions based on current information, not guarantees of future value.
3. Eligibility and Account Conduct
You must be at least eighteen years old to buy and sell through the shop, to submit cards for grading, and to enter into a consignment arrangement. A person under eighteen may take part in a transaction with the involvement of a parent or legal guardian who accepts these terms on their behalf.
You agree to provide accurate contact details, to use an email address and telephone number that you are entitled to use, and to keep the shop informed of any change in delivery details before a shipment is dispatched. You also agree not to place orders with no intention to pay, not to submit cards that you do not own or have authority to sell, and not to use the website to send unlawful, threatening, or deceptive content.
We may decline a transaction, close a break slot, or refuse service at the counter when we have a reasonable basis to believe that information supplied to us is false, that a card is stolen or counterfeit, or that a payment method is being misused. We will explain the reason where we lawfully can.
4. Orders and Acceptance
An offer to buy a card or a case break slot becomes binding when we confirm availability and accept payment, or when a written reservation is issued. Placeholder inquiries, want list requests, and price questions are not orders. A card shown as available on the website or in a listing may have been sold at the counter since the listing was prepared, and availability is confirmed only when a staff member responds.
Where an order cannot be fulfilled because an item is unavailable, we will contact you and offer a comparable alternative or a full refund at your choice. We will not substitute a different card, grade, or product without your explicit agreement. Reservations on singles are held for five business days unless a different period is agreed in writing.
5. Pricing and Availability
Prices are set from recent sold data, condition weighted comparables, and current market demand. Prices may change without notice as the market moves, but the price confirmed at the point of sale applies to that transaction. A quote given by email is valid for seven calendar days unless the quote states a different period.
If a pricing error is discovered before shipment, we will contact you with the correct price and give you the option to proceed at the corrected price or cancel for a full refund. We will not silently charge a different amount. Where a listed price is obviously below market because of a typing error, we may decline the order and explain the error rather than complete a sale that would be unfair to both sides.
6. Payment Terms
We accept the payment methods shown at the counter and any methods stated in a written quote. Card payments are processed through a payment provider, and we do not store full card numbers. Payment must clear before a card is released or a shipment is dispatched, except where a written credit arrangement has been agreed in advance with a business customer.
Sales tax is charged where required by law and is shown on the receipt. Prices quoted by email may exclude tax and shipping unless the quote says otherwise. Returned payments, chargebacks, and stopped payments may result in the suspension of pending shipments while the matter is investigated. We will cooperate fully with a legitimate chargeback inquiry, and we ask that you contact us first so that a misunderstanding can be resolved directly.
7. Shipping and Delivery
Shipments are packed to protect the cards and to support a claim if something goes wrong. Singles are shipped in sleeves, toploaders or card savers, and team bags, with rigid backing. Sealed product and graded slabs receive corner protection. Tracking is provided where the carrier offers it, and signature requirements are available on request.
Risk of loss passes to you when the carrier records delivery to the address you supplied, except where the law provides otherwise. If a package is lost or damaged in transit, contact us promptly with photographs of the packaging and the contents. We will open a carrier claim and work with you toward a resolution. Address errors supplied by a customer may result in reshipment charges when a package is returned to us.
8. Returns and Refunds
The return window and conditions are printed on the receipt for each purchase. A return generally requires the original receipt, the item in the condition in which it was sold, and the original packaging where relevant. Refunds are issued through the original payment method where possible, and trade credit may be offered as an alternative at a better rate.
Returns are not accepted for cards that have been altered, cleaned, trimmed, reholdered, or damaged after the sale, nor for sealed product once the factory seal has been broken. Graded cards are not returnable on the basis of a grading opinion, because the grade is the product of a third party grader. A slab that arrives damaged or mislabelled is handled as a transit or service issue rather than a change of mind return.
Where a return is accepted, we inspect the item before issuing a refund. If the item differs from what was sold, we will contact you before making a decision. Nothing in this section limits a statutory right to a remedy for goods that are not as described.
9. Sealed Product Policy
Sealed product is sold as a collectible and a chance based product. We disclose the distributor source, arrival date, and any visible wear before sale. Buyers are welcome to inspect seals, tuck flaps, and corners at the counter. Once the factory seal is broken, the sale is final, because the condition of a collectible box cannot be restored.
We do not search packs, weigh modern packs, reseal boxes, or offer loose packs taken from opened boxes as if they came from a fresh box. Where a product is known to have a manufacturing defect, we will say so and help you pursue the manufacturer remedy. Sealed product is not a guarantee of a particular card, and the absence of a desired card in an opened box is not a defect.
10. Card Condition and Grading Opinions
Raw card condition is described as carefully as we can, using standard terms for centering, corners, edges, and surface. Photographs and descriptions are provided to help you judge a card, but a photograph cannot capture every flaw. If condition is critical to your purchase, ask for additional photographs or inspect the card at the counter before payment.
A grading opinion belongs to the grading company that issued it. We do not grade cards ourselves and we do not guarantee that a third party grader will award a particular number. When we recommend grading, we are offering an opinion about likely outcome and cost recovery, not a promise. Vintage cards in particular can show print defects that affect a grade in ways that are not visible in a listing photograph.
11. Grading Submission Service Terms
When you submit cards for grading through us, you authorise us to act as your agent for the limited purpose of preparing, shipping, tracking, and receiving the submission. You confirm that you own the cards or have authority to submit them. You will receive an intake sheet listing the cards, declared values, service tier, and expected turnaround, and you should check that sheet before leaving the counter.
Declared values are used for insurance and for grading company paperwork, and they must be honest. Inflating a declared value can invalidate insurance coverage and can create a customs or carrier problem. We may decline to accept a declared value that is not supportable. Grading fees, shipping, insurance, and any applicable return shipping are payable as stated on the intake sheet, and some fees are non refundable once a batch has shipped.
Turnaround estimates come from the grading company and can change because of volume, staffing, or events outside our control. We will keep you informed of material delays. If a card is damaged in transit or in the grading process, we will help you pursue the relevant insurance claim and will document the condition at intake. Our responsibility for a loss is limited as described in the liability section, and the grading company terms apply to the grading itself.
12. Trade-In and Buyout Terms
Trade-in offers are made in writing after an open sort at the counter. An offer states the amount, whether it is cash or trade credit, and the reasoning behind the valuation. Offers are valid for the period stated on the written offer, usually the same business day, because market prices move. An offer is accepted when both parties sign the record and the cards are handed over.
You confirm that you own the cards offered and that they are free of any lien or claim. We may ask for identification for high value transactions, as required by pawn and secondhand dealer rules or by our own fraud prevention policy. We do not buy counterfeit cards, cards that have been trimmed or recoloured without disclosure, or sealed product that cannot be verified. If a card is later shown to be counterfeit or altered, the transaction may be reversed and the purchase price recovered.
Trade credit is usable for purchases at the shop and is subject to the terms printed on the credit record. Credit is not transferable unless we agree in writing, and it may carry an expiry date that is disclosed at the time it is issued.
13. Case Breaks and Live Sales
Case break purchases reserve a slot, team, or box as described in the announcement for that break. Assignments are posted before the break opens, and a random assignment uses a published procedure. A participant who purchases a slot accepts the product and the assignment method described in the announcement. If a break cannot proceed as scheduled, we will offer a new date, a substitute product of equal value with your agreement, or a refund under the published break terms.
Cards pulled for a participant are shipped to the address supplied at purchase. Shipping costs and timing are stated in the break announcement. A participant who does not supply a valid address within the stated period may have cards held at the shop for collection, and storage beyond a reasonable period may attract a fee that is disclosed in advance.
Live sales follow the same principle: items are described before bidding, condition notes are read aloud where relevant, and shipping is quoted before the sale closes. Proxy bids must be arranged with a staff member before the item is offered, and the proxy terms will be confirmed in writing.
14. Card Shows and Events
Event entry, table reservations, and dealer participation are governed by the published event notice in addition to these terms. The event notice states the date, venue, entry fee, table fee, setup times, and any special rules for the hall. A table reservation is confirmed only when the fee is paid and the confirmation is issued.
Dealers must comply with the price policy and the floor plan for each event. We may reassign a table to balance the product mix or to accommodate accessibility needs, and we will give as much notice as possible. Visitors must follow venue safety rules, and anyone who behaves abusively toward dealers or staff may be asked to leave without a refund.
We may photograph or record an event for documentation and general promotion. If you do not wish to appear in a published image as the main subject, tell a staff member at the event. Cancellation by us results in a refund of the table fee or entry fee, but we are not responsible for travel or accommodation costs.
15. Counter Conduct and Safety
The counter is a shared space, and every visitor is entitled to a calm and safe experience. We ask customers to handle cards with clean hands, to ask before opening a binder or a box, and to keep food and drink away from the display racks. Children are welcome and should be supervised near the glass cases and the grading slab display.
Threatening language, harassment, discrimination, and attempts to pressure staff or other customers are not tolerated. We may refuse service or ask a person to leave when conduct crosses that line. If a dispute arises at the counter, ask for the staff member in charge, and we will document the matter and respond in writing.
16. Intellectual Property
The text, layout, and original graphics on this website belong to The Cardfather LLC or are used with permission. You may view the site and print a copy of a page for personal use, but you may not copy the site content for commercial use, republish it, or present it as your own without written permission.
Trading card names, logos, player images, and set designs are the property of their respective owners. Our use of those names is descriptive and does not imply any affiliation with or endorsement by a card manufacturer, a league, a player, or a grading company. Photographs of cards that we sell are used to describe the specific item offered.
17. Limitation of Liability
To the extent permitted by law, The Cardfather LLC is not liable for indirect, incidental, special, or consequential losses arising from the use of this website or from a transaction, including lost profits, lost opportunity, or a change in the market value of a card. Our total liability for a transaction is limited to the amount you paid for the item or service giving rise to the claim.
This limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. Where a card is lost or damaged while in our custody for grading or consignment, recovery is limited to the declared value recorded on the intake sheet, subject to the applicable insurance terms. Nothing here reduces a statutory remedy that you are entitled to as a consumer.
18. Indemnity
You agree to indemnify The Cardfather LLC against claims, losses, and reasonable costs arising from your breach of these terms, from cards you supplied that you did not own or had no authority to sell, from counterfeit or altered cards supplied to us, or from your misuse of the website or of an event space. This indemnity does not apply to the extent that a claim results from our own negligence or misconduct.
We may participate in the defence of a claim at our own expense, and we ask that you notify us promptly of any claim that may involve a transaction with the shop so that records can be preserved while they are still available.
19. Dispute Resolution and Governing Law
If a problem arises, please contact us first. Most issues can be resolved quickly through a conversation at the counter or a written exchange by email. Send the details of the transaction, including the receipt or intake reference, and a clear description of what you would like us to do. We aim to respond within five business days.
These terms are governed by the laws of the State of Utah and the applicable laws of the United States, without regard to conflict of law rules. Any dispute that cannot be resolved directly will be brought in the state or federal courts with jurisdiction over Spanish Fork, Utah, unless a mandatory consumer protection rule gives you the right to bring a claim elsewhere.
20. Changes to These Terms
We may update these terms when our services change or when the law requires it. The revised terms take effect when they are posted on this page with a new effective date. A transaction is governed by the terms in force when it was completed, unless a later change is required by law or is more protective of the customer.
If a change is material, we will describe it in a short note at the top of this page. We encourage you to review this page before a large transaction, a grading submission, or an event reservation so that you know the current rules.
21. Contact Information
